1. Acceptance of Terms

By accessing or using our applications and services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our services. If you download or use an application through the Apple App Store, you also agree to Apple's Standard End User License Agreement (the "Apple EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula, which is incorporated by reference. If there is a conflict between these Terms and the Apple EULA regarding your use of the application, the Apple EULA will govern except with respect to the sections that Apple's guidelines permit us to supersede, such as Sections 6, 7, and 15 below.

2. Description of Service

We provide mobile applications and games for iOS and Android platforms. Our services may include, but are not limited to:

• Mobile applications and games
• User accounts and profiles
• AI-powered features, including an AI Try-On feature that generates a preview image from a photo you submit
• In-app purchases and subscriptions
• Social features and interactions
• Customer support services

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the security of your account and password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring you are at least 13 years of age (or the minimum age in your jurisdiction)

4. Acceptable Use

You agree not to:

• Use our services for any illegal purpose or in violation of any laws
• Violate any applicable local, state, national, or international law
• Infringe upon the rights of others, including intellectual property rights
• Transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of our services
• Use automated systems to access our services without permission
• Share, create, distribute, or possess any child sexual abuse material (CSAM)
• Sexualize, exploit, or put minors at risk in any way
• Upload a photo of another person to the AI Try-On feature (or any other feature) without that person's knowledge and explicit consent
• Use the AI Try-On feature or any AI-generated output to create misleading, defamatory, or non-consensual "deepfake" content, or to impersonate any person

5. Intellectual Property

All content, features, and functionality of our applications, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of SwoyeFlabs and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content without our prior written consent.

6. In-App Purchases and Subscriptions

Some of our applications offer in-app purchases or auto-renewable subscriptions ("Subscriptions") through the Apple App Store or Google Play. The title, duration, and price of each Subscription are displayed in the application before you confirm a purchase. By making a purchase, you agree to the following:

• Payment will be charged to your Apple ID account (or applicable app store account) at confirmation of purchase
• Subscriptions automatically renew for the same duration and at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period, and the renewal price will be identified in the application before purchase
• You can manage your Subscriptions and turn off auto-renewal at any time by going to your Account Settings in the App Store (or Google Play) after purchase — we do not have access to cancel subscriptions on your behalf
• Any unused portion of a free trial period, if offered, is forfeited once you purchase a Subscription
• All sales and purchases are final. Refunds are handled by Apple or Google in accordance with their respective refund policies, and by requesting a purchase you acknowledge that our applications do not directly process refunds
• Prices may change for future billing periods; where required, we or the app store will notify you in advance of any price increase and obtain your consent to continue the Subscription

7. AI Try-On Feature and Your Photos

Some applications include an AI Try-On feature that generates a preview image from a photo you submit. By submitting a photo, you represent and warrant that:

• The photo is of you, or you have obtained the explicit consent of the person depicted (or their parent/guardian, if a minor) to submit it
• You own or have the necessary rights to the photo and its use does not violate any third party's rights
• You will not use the feature to create content that is misleading, defamatory, harassing, sexually explicit, or otherwise violates Section 4 of these Terms

Details on how photos submitted to the AI Try-On feature are processed, retained, and deleted are set out in our Privacy Policy. We do not use these photos to identify you or any other person, and generated results are provided "as is" for preview purposes only — they are not a guarantee of fit, appearance, or product accuracy.

8. User Content

Our applications may allow you to post, upload, or submit content. By doing so, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and promoting our services. This license does not extend to photos submitted solely to the AI Try-On feature, which are used only to generate your requested result as described in our Privacy Policy.

You represent and warrant that you own or have the necessary rights to all content you submit and that such content does not violate any third-party rights.

9. Prohibited Content

You may not post, upload, or transmit any content that:

• Is illegal, harmful, threatening, abusive, or offensive
• Violates any child safety or anti-exploitation policies
• Infringes upon intellectual property rights
• Contains viruses or malicious code
• Is spam or unsolicited commercial content
• Violates the privacy or rights of others

10. Termination

We reserve the right to suspend or terminate your account and access to our services at any time, with or without cause or notice, for any reason, including but not limited to:

• Violation of these Terms
• Illegal activity or suspected illegal activity
• Sharing or soliciting inappropriate content involving minors
• Fraudulent, abusive, or harmful behavior
• Extended periods of inactivity

Upon termination, your right to use our services will immediately cease. You may request account deletion by contacting us at our account deletion page. Terminating your account does not cancel any active app store Subscription — Subscriptions must be cancelled separately through your App Store or Google Play account settings.

11. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• Our services will be uninterrupted, secure, or error-free
• Defects will be corrected
• Our services are free of viruses or other harmful components
• The results obtained from using our services will be accurate or reliable

12. Limitation of Liability

To the maximum extent permitted by law, SwoyeFlabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

13. Indemnification

You agree to indemnify, defend, and hold harmless SwoyeFlabs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our services or violation of these Terms.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of our services after such changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.
